Legal Privilege for European Patent Attorneys in Denmark

25 May 2018

On May 17, 2018, the Danish Parliament passed legislation to give European Patent Attorneys legal privilege to the same extent as lawyers. For years Danish corporations have suffered been at risk because the Danish legislation did not provide explicit legal privilege to patent attorneys. Denmark does not have a national authorization for patent attorneys so it has been a challenge to define the group of patent attorneys entitled to legal privilege. Now the legislation has been passed and it applies to all European Patent Attorneys. The Confederation of Danish Industry has been instrumental in bringing the problem to the attention of Danish politician. At the end the legislation was passed unanimously by Parliament.
